Woman sues police for assault and false imprisonment (PN & NSW Police)

Key Words: Assault – false imprisonment – unlawful arrest – successful settlement

Facts:

PN was the head of a sports organisation. The other directors badly bullied and harassed her, leading to her resignation. After she resigned, they made false allegations to the police about her.

The police invited PN to attend the station. When she arrived, they arrested her despite not adequately investigating whether PN had actually committed the crime of which she was accused.

PN took part in a record of interview where she explained the circumstances. As a result, she was released from custody.

PN approached O’Brien Solicitors to enquire into any claims of recourse she might have against the Police.

Outcome:

O’Brien Solicitors helped PN successfully sue the police for assault and false imprisonment (unlawful arrest). The matter was settled out of Court, with an outcome in favour of PN.
